Does Right to Equality really exist in India

Part III of the Indian Constitution confers some rights to the citizens and these rights are the basic or fundamental rights of every Indian. These rights are inherent rights of every citizen. However, these fundamental rights are not absolute rights and come with some restrictions.

Articles 14 to 18 of the Indian Constitution provides for Right to Equality. Article 14 provides for Right to equality before law and Equal protection of all. Article 15 provides for Right against Discrimination. Article 16 provides for Right to equality of Opportunity. Article 17 provides for Right against untouchability. Article 18 provides for Abolition of titles.

In recent times, it has been witnesses that Right to equality has been misused by our so-called political leaders. Reservation in education system has actually created a lot of discrimination among the people. This system was earlier introduced in order to provide equality to the backward section of our society. However, in this process of providing equality has created a lot of hurdles for other people, especially for students. Many students, who are meritorious, fail to get admission in good colleges due to this reservation system.

Right to equality means to give equal opportunity to all but why this discrimination? Recently, I met a boy who secured about 85% in his 12th boards but due to many seats being reserved for the backward classes, he failed to get admission in a good college. This is a definitely against the right to equality that has been guaranteed by our Constitution. Even this thing exist in Government jobs and in competitive exams like Civil service etc. where an individual from backward class is given the opportunity to appear for such exams till the age of 35 years and an individual from general class is given opportunity to appear only till the age of 30 years. Is it really reasonable to give a position to a 32 years old individual who scored 50% marks in the exam rather than a 25 years old individual who secured 80% marks? Does “Right to Equality” really exist? The thing that is isolating people or discriminating them on the basis of caste system is the reservation system. Indian Constitution although guarantees right to equality, it does not exist in reality. Still there is discrimination on the basis of sex, religion, caste and creed and these discrimination are tearing way the vast nation into pieces.

In my view, these discrimination can be stopped by abolishing the reservation system completely. Reservation should be for economically backward people who are meritorious but cannot get admission in colleges due to lack of finance. Nationalism is another way to bring equality among all Indians and unite the nation as one by removing all the discrimination on the basis of religion or caste. Nationalism can only protect our rights guaranteed by the Constitution of India, which is considered as the supreme law of the land. Moreover, it is the best way to bind the nation.
 
Right to equality that is conferred by our Constitution is now confined only in the books and does not exist in reality. Reservation is the main cause of disparity among the people of India and this is the reason, right to equality does not exist in reality in our nation. Right to equality can only be established by abolishing the reservation system from education system and government jobs.
 
In my opinion, right to equality still does not exist in India. Although, people talk a lot about women gaining equal status etc, it is not so. If right to equality existed in our society in reality, women would have not fallen victim of crimes like sexual harassment, dowry death, domestic violence, rape, etc. Right to equality can exist in reality only by uprooting the geneder discrimination that still exist in our society.
