The Indecent Representation of Women (Prohibition) Act, 1986 is enacted with an intention to prohibit indecent representation of women through advertisement or in publications, writings, paintings, figures or in any other manner and for matters connected therewith or incidental thereto. Section 7 of the Act states that any such offense whether committed by a company, every person who at the time the offense was committed, was in charge of and was responsible to the company for the conduct of the business of the company, as well as the company shall be deemed guilty of the offense and shall be liable to proceed against and penalized with imprisonment which may extent to 2 years or with fine which may extent to Rupees 2000/- or both and if the same is convicted for the 2nd time or subsequent time, punishment will be of not less than 6 months which may extent to 5 years and also with fine not less than Rs. 10,000/- but may extent to Rs.1 lakh. The offences under this act are cognizable and bailable.
