The recent arrest of the two girls for a Facebook post protesting the Mumbai bandh after the death of Balasaheb Thackerey. The arrest was under 66(A) of the IT Act and the arrest created a lot of havoc in the whole nation. What do you think? Why the Information Technology (IT) Act has no place in a modern democracy? Why our fundamental rights are infringed?

Some people are booked and jailed for posting innocuous comments or sarcastic cartoons on the internet. This is a gross violation of our fundamental right to free speech and expression. Section 66A, IT Act, with its wide and very vague language, has been, misinterpreted and used wrongly. Therefore there is hope that the Supreme Court may scrap the Section all together and replace it with an aptly worded Section that defines what constitutes a crime under the current section. In words that are definite and not open to misinterpretation and misuse by politician, the police or the common man. This Section itself is flawed and to rectify this flaw the entire Section 66A should be re looked at and changed so that it cannot infringe on our fundamental rights to free speech and expression. The particular Section (Section 66A) of the Act can be challenging because the recent arrest under 66(A) of the IT Act created a lot of havoc in the whole nation. The recent arrests have shown that it can be used to silence views expressed in a democracy, and free speech is the essence of a democracy.
